The American Supply Association, in collaboration with Intertek, will be providing a webinar on California Proposition 65 (Prop 65) regulation compliance and its upcoming changes.

The webinar will be tailored to meet ASA’s unique membership needs and will answer many of the questions on this complex regulation, which applies to nearly every business selling products into California. What is Proposition 65?

Proposition 65, which became law in November 1986, requires businesses to provide warning to Californians about significant exposures to chemicals that cause cancer, birth defects or other reproductive harm. The Prop 65 list currently contains more than 900 chemicals.

On Aug. 31, 2016, the California Office of Environmental Health Hazard Assessment adopted amendments to Article 6, Clear and Reasonable Warnings for Prop 65. The new regulations in Subarticle 1 include mandatory requirements for various entities within the supply chain. Subarticle 2 establishes specific guidance on methods and content for safe-harbor warnings. These amendments will become effective Aug. 30, 2018.

Who must comply with Proposition 65?

Anyone in the course of doing business who manufactures, produces, assembles, processes, handles, distributes, stores, sells or otherwise transfers a consumer product which he or she knows to contain a chemical known to the state to cause cancer or reproductive toxicity in an amount that requires a warning, shall provide a warning to any person to whom the product is sold or transferred unless the product is packaged or labeled with a clear and reasonable warning. The warning message must clearly communicate to Californians that the chemical in question is known to the state to cause cancer, or birth defects or other reproductive harm.

Challenges with compliance

ASA understands Prop 65 can add challenges to the way business is conducted. One of the biggest challenges on understanding Prop 65 is how to determine if a certain product contains a chemical that requires compliance; or how to derive a safety-harbor level; or how the contents of the warning message should read. Whatever the concern is, the webinar will assist in answering these questions and provide additional clarity.

ASA members have asked many questions on understanding Prop 65. To address the various questions, ASA, in collaboration with Intertek, will be providing a webinar to go over Prop 65 in plain language. It will explain the main concepts and will give guidance on how to comply with the regulation. The webinar also will provide guidance on determining if your product contains a chemical that requires compliance, how exposure is assessed, and how a safe-harbor level is derived.
