A 2002 court decision stating cross-linked polyethylene (PEX) pipe does not have to undergo environmental review in California was reversed on Nov. 18. The new decision, by the California Court of Appeals, requires PEX be evaluated under the California Environmental Quality Act.

The ruling bars PEX from being adopted into the 2001 California Plumbing Code.

The Plastic Pipe and Fittings Association - which represents many PEX manufacturers, including Wirsbo, REHAU, Vanguard Industries and Marshall Brass, among others - is calling on Gov. Arnold Schwarzenegger to uphold his campaign promise in 2003 to include PEX pipe in the California Plumbing Code, according to a statement the organization issued.

Supporters of this new decision include the California Pipe Trades Council, Sierra Club and California Professional Firefighters Association.
